On or about July 30, 2018, Hisham forwarded Mustafa with a response to a query from the databases regarding Cohen, according to which Cohen ceased to be a resident of Israel in 1978 and Mustafa forwarded the answer to Adv. Hanifas.
On a date that is not known to the accuser, in October 2018, Mustafa contacted Majdi and told him that 500/22,120 plots (representing an area of 500 square meters) of the land were being offered for sale for ILS 80,000 in addition to purchase tax to be paid by Majdi. In addition, Mustafa noted that the defendant, as part of his practice as a lawyer, represented the parties in the transaction. Mustafa did all this on the defendant's mind.
Later, the defendant signed a document with Majdi entitled "Sale Agreement", in which it was written, without Cohen's consent and without Cohen's knowledge, that Cohen undertook to sell the plot to Majdi for a payment of ILS 80,000 (hereinafter: the "Sale Agreement"). The defendant signed the sale agreement with Majdi, knowing that Cohen was not aware of the sale agreement and did not authorize him to sell parts of the land.
The defendant tried to fraudulently obtain the land, for Majdi, under aggravated circumstances, while the defendant pretended to be the power of attorney of the landowner. For this purpose, he forged many documents with the intention of allowing the registration of ownership of the land in Majdi's name - a power of attorney, a declaration to the Tax Authority (in which he wrote that the consideration for the land was ILS 58,000, knowing that the actual consideration for the land was ILS 80,000 in order to evade paying tax), a sale agreement and a request to register a warning note.
On November 21, 2018, the defendant submitted the declaration and the forged sale agreement to the Haifa Real Estate Taxation. In addition, he submitted to the Land Registry Office in Haifa the application for the registration of a warning note and the power of attorney, and based on them, a warning note was immediately registered in the Land Registry.
