Relying, inter alia, on the forged bill of sale, on March 13, 2013, the registration of ownership in the land registry was transferred - 400 square meters of the land to Louis, 2,400 square meters of the land to Badia and 6,200 square meters of the land to Fadi, in lieu of registering the ownership of all the land in their names.
The defendant sent a hand in the sum of ILS 90,000, which was deposited with him, by Fadi, in order to transfer them to Rachel as part of the transaction, fraudulently, for his own use.
The Facts of the Tenth Indictment
- On the relevant dates of the indictment, Adv. Amir Hanifas was engaged in real estate (hereinafter: " Hanifas") and Rafiq Mustafa Halabi (hereinafter: "Mustafa") was engaged in real estate brokerage. Against the background of the defendant's and Adv. Hanifas' occupations, they had business and friendship relationships. Mustafa and Adv. Hanifas also had business connections, against the background of their occupations.
At the relevant times of the indictment, Dan Cohen (hereinafter: "Cohen"), a resident of the United States, was in a nursing medical condition. Cohen was registered as the owner of 1,500/22,120 parcels (representing 1,500 square meters) in the land identified as Plot 48 in Block 11519, in the Daliyat al-Carmel Local Council (hereinafter: the "Real Estate"). There is no prior acquaintance between Cohen and the defendant.
On a date that is not known to the accuser, in May 2018, Majdi Abu Mufleh (hereinafter: "Majdi") approached Mustafa, as part of Mustafa's real estate brokerage, in order to purchase a plot of land under the jurisdiction of the Daliyat al-Carmel Local Council.
On July 24, 2018, the defendant contacted Adv. Hanifas with a request to receive a summary of Cohen's registration and entry and exit details from the country. On July 25, 2018, Attorney Hanifas asked Mustafa to receive the summary of the registration and wrote to him, "It's for me to ask a friend of yours to bring it to you from the Ministry of the Interior." Mustafa contacted the Hisham Brigade (hereinafter: "Hisham"), an employee of the Ministry of the Interior, and asked for a summary of Cohen's registration.
