General Part
- On the dates relevant to the indictment, in accordance with the court's decision of March 21, 2021, in the framework of the main case (given by the Honorable Judge Orit Kantor before the case was transferred to this panel), the defendant was prevented from representing in the courts and in the various state courts and authorities, from engaging in private practice, from opening trust accounts, from submitting documents to state institutions, and he was also allowed to work only at Raed Zohar Ltd.
- In addition, the defendant was prevented from practicing law in accordance with the decisions of the District Disciplinary Court of the Haifa District Bar Association, in Case No. 060/2020 of July 8, 2021, and in Case No. 024/2019 of July 15, 2021.
- Salameh Zidan (hereinafter: "Salameh") is the father of Adham Zidan (hereinafter: "Adham"). At the time of the indictment, Adham and Salameh owned a legal services firm located in Daliyat al-Carmel. On the relevant dates of the indictment, Adv. Moin Hasson worked as an employee of the firm (hereinafter: "Mo'in")
The Facts of the First Indictment
- At the relevant times of the indictment, Baha Kayuf (hereinafter: "Baha") was registered in the Land Registry (hereinafter: "the Land Registry") as the owner of 71676/1919 parcels (representing an area of 480 square meters) in the land identified as Plot 36 in Block 17141, within the jurisdiction of the Isfiya Local Council (hereinafter: "the Real Estate").
On a date unknown to the accuser, on and around February 7, 2022, the defendant decided to defraud Baha, in such a way that he would write a warning note about Baha's rights in the land, without his knowledge and consent and unlawfully (hereinafter: the "Decision").
To this end, the defendant made a request to register a warning note in his favor regarding the right of ownership of the land, without Baha's knowledge and consent and without lawful authority. In addition, the defendant forged a sale agreement between him and Baha, according to which Baha sold the land to him for ILS 30,000. The defendant submitted the forged sale agreement and the application to the Land Registry Office in Haifa, and on the basis of these, a warning note was registered in his favor, on February 16, 2022.
