The Facts of the Second Indictment

  1. On the relevant dates of the indictment, the late Moshe Fishbein and the late Leah Fishbein (hereinafter: "the deceased" and "the deceased", respectively), were registered in the Land Registry as the owners of 1500/17919 parcels (representing an area of 1500 square meters) in the land identified as Plot 36 in Block 17141, within the jurisdiction of the Isfiya Local Council (hereinafter: "the land"). On May 29, 1986, the deceased passed away, and on May 15, 1996, the deceased passed away, and their heirs are their children.

On a date that is not known to the accuser exactly, on April 3, 2024, the defendant decided to defraud the heirs of the deceased and the deceased, in a manner that would transfer the rights of the deceased and the deceased in the land to Raanan Hasson (hereinafter: "Ra'anan").  Following his decision, the defendant forged an application to register a warning note and an irrevocable power of attorney, and on April 4, 2024, a warning note was registered in favor of Ra'anan.

On a date that is not known to the accused, moving to October 10, 2024, the defendant decided to defraud the heirs of the deceased and the deceased, in a manner that would transfer the rights of the deceased and the deceased in the land to Naim Kiuf (hereinafter: "Naim").  For this purpose, he forged an application to register a warning note and a sale agreement according to which the right of ownership in the land is transferred to Na'im for ILS 129,000.  On October 13, 2024, a warning note was written in favor of Naim.

On a date that is not known to the accuser exactly, on and around December 1, 2024, the defendant forged an application to register a warning note in the real estate in favor of Hussein Malek (hereinafter: "Hussein").  The defendant submitted the application to the Land Registry Office, and after an examination conducted at the office, which revealed that the owner of the land had died, the request was rejected.

For the purpose of his actions, the defendant forged both the signatures of the deceased who owned the land and the signatures and stamps of lawyers, including a deceased lawyer.  In addition, through Adham, he submitted the applications for registration with the bureau online.
