The Facts of the Third Indictment
- "Tanel Property Investment Company Ltd.", 510779085 Company (hereinafter: the "Company"), was incorporated on March 29, 1978 and was delisted on December 23, 1985. Daniel Lavi Akoka (hereinafter: "Daniel") and the late Nosig Rosenberg, who passed away on February 4, 2023 (hereinafter: "the deceased"), were shareholders in the company in equal shares. The company is registered in the Land Registry as the owner of 3.855 dunams of land identified as Plot 7 in Block 11515, within the jurisdiction of the Isfiya Local Council (hereinafter: the "Real Estate").
On a date that is not known to the accuser exactly, on and around July 6, 2024, the defendant decided to defraud Daniel and the deceased's heirs, in a manner that would transfer the rights of the deceased and Daniel in the land to others.
Shortly after August 8, 2024, the defendant or someone on his behalf forged a request to register a warning note in favor of Iyad Farhat (hereinafter: "Iyad") and Safaa Hadid (hereinafter: "Safaa") regarding the right to ownership of the land. The defendant also forged a sale agreement between the company and Iyad and Safaa. The defendant submitted these documents to the Land Registry Office, and on the basis of these, a warning note was immediately registered in the Land Registry.
Later, the defendant tried to fraudulently obtain a proprietary right of ownership of the land for Iyad and forged a bill of sale, according to which the company allegedly transferred ownership of the land to Iyad. He also forged a declaration form to be submitted to the Real Estate Taxation Office, stating that for the sale of the land, a monetary consideration of ILS 350,000 was agreed upon in order to evade tax. Based on these, Iyad paid the taxes and received approval for registration from the Real Estate Taxation.
On November 3, 2024, Iyad entered into a real estate sale agreement with Alaa Hasson (hereinafter: "Alaa"), Anan Gadban (hereinafter: "Anan"), Safaa Hadid (hereinafter: "Safaa") and Roni Wahabi (hereinafter: "Roni"), according to which he would sell 500 square meters of the land to Alaa for ILS 70,000, to Anan 855 square meters of the land for ILS 103,000, to Safaa 500 square meters of the land for ILS 70,000, and to Roni 1 dunam of the land for ILS 120,000.
