In the case before us, we were not at all under the impression that the investigative unit acted deliberately to avoid collecting exculpatory evidence or acted to produce incriminating evidence against the defendant specifically, and it was clear that a great deal of action was taken in order to objectively, skilled, in good faith and professionally examine the route of the Chevrolet vehicle by means of security cameras, even before the connection between the Chevrolet vehicle and the defendant was established.

At this stage, it should be recalled that in practice, less than four hours after the murder, around 10:00 A.M., the defendant was seen arriving in a Chevrolet car to Rafi Abdayev's work compound wearing a mask.  The defendant took the trouble to park the car in a corner of the compound (P/227), take out a bag (similar to the one held by one of the murderers) and travel with Rafi Abdeev and one of his employees in another vehicle.  Murphy Abdayev The defendant asked for ILS 10,000, and he also asked him to bring the Chevrolet to Eliran Sabag's car lot in Nesher, from which he had taken it, in light of some malfunction, claiming that the car was not moving, although Rafi Abdeev was actually supposed to drive it (testimony of Rafi Abdeyev, 11 May 2023, pp.  2465 ff.).  In any event, since Rafi Abdeev did not have time to do so, the defendant arrived the next day, i.e., on March 25, 2021, and took the car.

According to Ituran's data (P/138, p.  6), the vehicle was parked in Rafi Abdeev's business compound from 24 March 2021 at 10:34 A.M., until the next day, 25 March 2021 at 17:33.  The defendant was then transferred to HaKomemiyot Street in Kiryat Yam, where the vehicle was parked from 5:37 P.M., until the next day, 26 March 2021, at 2:02 P.M.  Two hours later, the defendant was arrested while driving the Chevrolet (P/456).

Additional circumstantial evidence, which is of great significance to us, is embodied in the shoes that were found on March 27, 2021, under a bush (a young citrus tree) on Stockholm Street in Daliyat al-Carmel, when it was claimed that one of them had a genetic profile of the defendant and the other a genetic profile of the deceased, and in the coats that were allegedly found, at night, on March 25, 2021, among bushes in a vacation camp in Carmel Park, between the settlements of the Carmel Ridge and the Elyakim Interchange.  When a genetic profile of the deceased was found on one of them.
