The defendant categorically denied that he had made a decision to kill the deceased.
He also denied that on March 21, 2021, the vehicle was purchased. According to him, even before March 21, 2021, he had expressed interest in purchasing the car for his son Ariel. For this purpose, he made a short trip by car, to check the integrity. He noticed mechanical and electrical problems and made the purchase of the car conditional on the repair of all the defects. Therefore, it was agreed that the vehicle would be delivered to the defendant after it had been treated and repaired to his satisfaction.
On March 21, 2021, the defendant took possession of the vehicle in the parking lot, after being told that the defects had been corrected, but that it was a misrepresentation. As of 23 March 2021, at noon, the vehicle was parked near the defendant's residential address. On that day, at the request of a man named Aviel Dadon, the defendant left the car keys on the wheel of the car, after Aviel Dadon asked him to borrow the car for himself.
The defendant denied that he conspired with another person to cause the deceased's death. The defendant denied that the two arrived in the car, armed with knives, denied that they approached the deceased's car wearing coats and hats covering their heads, and that they wore "corona masks" and gloves on their hands. The defendant further denied cutting a tire in the deceased's car, entering the yard of the deceased's home, attacking the deceased and stabbing him with the intent to kill. The defendant denied the accuser's claim that she caused the death of the deceased with the other, but it was agreed that the deceased's name was caused by a stab wound.
The defendant denied the claim that he had left the yard with the other, that he had walked toward the car, and that they had fled the scene, while the defendant was driving the car. He also denied that he had traveled with the other in a car to Daliyat al-Carmel, where the shoes he was wearing were hidden among bushes, and that later, near the exit from Daliyat al-Carmel, they hid his coats between bushes, and that later, in an area near Tiberias, on a dirt road, they threw car mats and two license plates that were in the car, which had been stolen from another vehicle in Kiryat Motzkin the day before.
