The defendant further claimed that on the day of the incident (24 March 2021), the vehicle was handed over to him, at around 09:00, in the area of the Rashbi Tomb compound in Meron, by Aviel Dadon's friend. Immediately afterwards, the defendant continued and drove towards the Krayot in order to meet a man named Rafi Abdeev, in order to receive a loan in the amount of ILS 10,000, which he had agreed to the day before, money that would be used to pay attorney Arnon Savyon, who handled a civil matter for him. Rafi Abdaev noted that he was going to go later in the day to install windows in Tel Hanan, so the defendant asked him to transfer the car to the car lot of a man named Eliran Sabag, in order to repair the defects that were discovered in it during the trip. He did not do so in order to thwart a judicial proceeding.
On March 25, 2021, since Rafi Abdayev stated that he was "stuck" in the installation until the evening of March 24, 2021, and did not move the vehicle to the designated lot, the defendant did indeed take the vehicle. The defendant confirmed that he was arrested by the police on 26 March 2021 while he was driving.
Thus, in summary, in his defense, the defendant claimed that at the time of the murder he was in another place, staying at Rashbi's grave on Mount Meron and its environs, from the afternoon hours of March 23, 2021, until the morning hours of March 24, 2021, including at the time of the murder.
During the course of the proceeding, it was argued that the defendant had no connection to the murder in question, nor did he have a reason to murder the deceased, and certainly not a motive, especially since he had good factual and legal documents and arguments against the defendant in the various legal proceedings in which the deceased was involved. The defendant, as stated, purchased the plots lawfully and had an interest in the deceased carrying out the distribution, so that the ownership could be registered at the Land Registry Office. The defendant, as stated, was not at all aware of the lawsuit filed against him in the District Court for declaratory relief, no warning letter was sent in respect of it, and no hearing has yet been held (see: November 26, 2023, p. 3164). It was explained, "The only person whose land was the safest in this whole business was the defendant, he was the one who was under contractual agreements, he was the one who was registered in the land registry and he was the one who paid money for betterment tax" (p. 3165). The defendant was in fact calm, his rights were backed by written documents, and he had no reason to fear any legal proceeding of which he was not aware of at all.
