The defense expert's opinion in this context was not based on a finding but on probability. The defense expert was of the opinion that the lack of a genetic profile on the coats indicates the likelihood of the scenario raised by the defense; His words in this context did not convince us, nor did they cast a shadow of doubt in our minds; The fact that this witness gave his testimony when he was not at all aware of the consolidation of the evidence in the context at hand strengthened our impression.
As far as the comparison of the profile with the genetic profile found in the database is concerned, it was submitted without any objection from the defense. Since the defense did not express any objection to the submission of the opinion based on the same comparison according to the laws of evidence, it is considered to agree with the assumption implicit in the evidence - that the profile in the database correctly reflects the genetic profile of the defendant.
