The aforementioned referred to the bathroom. Sales in the bus sector were mentioned separately. Navot wrote on July 14, 2016, that he had sat down with Misha (Goldberg, director of the field at Lehavot; p. 153, paras. 26-28) and Doron (who was originally recruited by Danan to promote the field of hoods; M/50), and that Misha said that there was a field that he did not reach and that Doron could start with.
- On July 21, 2016, Haim (Lehavot) wrote to Navot (Danan), still in the context of the summary of the July 6, 2016 meeting, that there were still a number of comments, including: "I explained that there will be no sales of bus systems by [Danan]. perhaps at a later stage after the market stabilizes" (M/63).
There was no response from Danan to this email. As we shall see, a real reference, certainly in writing, by Danan to this content regarding the buses can be found only about a year later, in July 2017.
- In the summary of the meeting held in September 2016, there is a distinction between the field of hoods and the field of buses. In the matter of buses, it was written that teams of technicians would be ready to work in November 2016, that "fire incidents" would be transferred to Danan on the buses, and that Lehavot would involve Danan in the early stages of bus projects before a final offer to the customer (M/71).
In an email from the beginning of November 2016, in which Navot mentioned the summary of the September meeting, it was written, among other things, that from the next day, Danan would be independent "with our teams on the buses," when "there is a gap with the south," and Nir (Lahavot) needed to be addressed "in order to move forward" (M/85).
- In February 2017, Danan's technician, Sha'abo, was given a certificate of certification for installation and installation inspection in Lehavot's bus systems (M/135).
Summary of a meeting of Lahavot from March 2017 on the subject of "Work Processes between Lehavot and A. Danan" (M/107) deals mostly with the field of hoods, but also includes reference to buses, including the manner in which an order for the installation of bus systems will be transferred from Lehavot to Danan, where Lehavot is the orderer (section 8), receiving service calls and issuing approvals ("etc.) only in Lehavot (section 9), quality assurance audits on the installation of bus systems and service for these systems (section 11), and more. It is not clear whether this document was transferred to Danan in real time or was known to her.
- Towards the end of April 2017, the parties exchanged e-mails regarding a customer's complaint regarding the conduct of the staff in question when repairing a bus malfunction (M/109). - The following reference to the bus sector was identified in a letter dated July 18, 2017 from Danan's attorney at the time (M/133)[3]).
The letter is titled "Breach of the Agreement of June 28, 2015" and raises claims of fundamental breaches of the agreement in a fairly comprehensive manner. Subsequently, it was argued that Danan was concerned about the continued violations and could no longer bear the damages, and the letter demanded that Lehavot cease any action that contradicted the exclusivity given to Danan and transfer to Danan "the direct connection with all market entities in the field of hoods" (section 5). There is no parallel requirement regarding the bus sector.
