Judgment

  1. Before a monetary claim, in the amount of ILS 11,966,57, concerning an allegation of breach of an engagement agreement for the provision of communications services, by way of non-provision of all the promised services, and of overcharges. Negotiations were conducted between the parties via text messages (the text message alternative was attached as Appendix 2 to the statement of claim), and after the transaction was sent, a notice was sent by one of the defendants by e-mail (the details of the shipment will be discussed below) containing a summary of the transaction, which differs in content from the summary in the text messages.  The plaintiff did not send any objection as to the content of the said email message (and in any case denies that he received it).  The claim consists of the following: ILS 466 overcharge charge, ILS 4,000 compensation for time spent, and ILS 7,500 compensation without proof of damage, due to a violation of the provisions Consumer Protection Law, 5741-1981 (hereinafter - "The Law").
  2. Apart from the evidence submitted in the documents (especially those already mentioned), only a single testimony was heard, by the plaintiff. The defendants made do with sending a professional representative, who can only describe what emerges from the documents in her possession, but not one that can shed practical light firsthand on the actions that were taken.  In practice, the plaintiff's testimony does not add much to the content of the text messages, which speak for themselves.
  3. In the statement of claim, the plaintiff details the terms of the transaction, as they appear in a series of text messages that were exchanged (at the end of the negotiations) between him and a sales representative named Coral Harush, on November 27, 2024, at 14:38-14:39, and we will quote the terms from the text messages in their language (punctuation and spelling errors were left, as well as line breaks - Z.L.):
