His testimony in court was heard at the hearing on January 9, 2023.  In his cross-examination, the witness clarified that he himself did not treat the deceased, and when he arrived at the scene, the deceased was treated by other medics.  He confirmed that he was involved in writing the incident report, and that it was recorded from his mouth, that the injured man in the yard of the house was vaguely conscious - opened his eyes and looked at them "in a strange way." In this context, he noted that this does not necessarily indicate that the injured person was conscious (p.  681, paras.  5-6), but that he may have lost it a second or two later, as often happens in accidents.

  • United Hatzalah ambulance driver, paramedic Yosef Zaguri, A.T. 27 - his statement was submitted to the police, dated 24.03.21 (P/33).

According to him, when he arrived at the scene, following the call he received, he found teams from United Hatzalah, MDA and the police there.  His activities focused on transporting the lightly injured man, the defendant, together with the paramedic Peniel Buskila (below), in an ambulance to the hospital.

His testimony in court was heard at the hearing on 9 January 2023.  During the meeting, he explained his part in the handling of the incident, when he said that his statement to the police, "We have begun treatment", in relation to the defendant, does not necessarily mean actual treatment, but rather that the injured person was lifted to a stretcher and evacuated by ambulance to receive treatment at the hospital.  The witness ruled out the need to stop the ATDs, i.e., bruising in the defendant, by means of a tourniquet barrier (which, according to him, is under the authority of a medic), as opposed to stopping bleeding, which was done in the field, by placing a bandage on the bleeding incision.

  • United Hatzalah volunteer, paramedic Peniel David Buskila - his statement was submitted to the police, dated March 25, 2021 (P/34). The aforementioned did not testify in court.

According to him, when he arrived at the scene, following a call he received, he found volunteer Netanel Attias treating a moderately injured man (the defendant).  They put him in an MDA ambulance, but after they were called to the scene where he was seriously injured (the deceased), it was decided to transfer the lightly injured man to a United Hatzalah patrol car.  The aforementioned accompanied the evacuation of the moderately injured man to the trauma room at Soroka Hospital for further treatment.  He also said that the injured man was called Maor, and he "was very confused, very sleepy, and mostly said yes, yes, there was no one with us" (Q.  16-17).

  • Civilian Witnesses:
  • The neighbor, H.Z., A.T.10 - Her statement was submitted to the police, dated 31.03.2021 (P/44); the transcript of the interrogation (P/44A); the CD documenting her (P/44B, including a diagram she made describing her location in relation to the grandmother's house; and a reconstruction made to her (P/23, including the transcript of the reconstruction P/23A).

She was a woman who lived relatively close to her grandmother's house.  According to her, when she went out to throw the garbage, she saw someone thin, with blood on her hands, running up the street.  She did not know the defendant, the deceased, or Grandma Aisha, nor did she see exactly where he had come from.  The distance between them was about 3.5-4 meters, and she quickly saw him being treated in an ambulance, which arrived at the scene.
