In his re-examination, and when the plaintiff presented him with the data, according to which the deceased's treatment began at 09:35 and by the time he arrived at the hospital, at 09:58, he was already without a pulse and without breathing, that is, after 23 minutes of treatment, during which the deceased's condition deteriorated, and asked what could have been done during this time period to save him, the witness replied that it might have been correct to insert a device into both lungs, according to the assessment that the air intake to both of them is reduced (p. 674, para. 22), but even in this operation, the effectiveness is limited. The witness further agreed that theoretically, and if we are talking about chest air under "net" pressure, and not a situation of massive blood loss, or active bleeding in the abdomen, it is possible that the deceased could have been saved.
Again, and even on the assumption that the doctor's testimony can confirm the thesis that death was caused (or that was felt, or that impaired the chances of survival) as a result of penetration into the wrong lung - this does not detract from his basic testimony that the cause of death was multiple stab wounds to the chest and neck. Certainly this is not a case of medical negligence that caused the death of the deceased "immediately and exclusively".
Autopsy Findings - Cause of Death
- The father of the deceased, Shimon Dadon , submitted his statement to the police, dated March 24, 2021 (P/43). It should be noted that this is not an investigation, but rather the father's signature on a consent form for the autopsy.
- Alon Krispin, of the Institute of Forensic Medicine, A.T. 24 - An expert opinion was submitted, dated April 22, 2021, prepared by the witness (P/11), in place of his main testimony. In the body of the opinion, in a detailed manner and over a number of pages, the bruises found on the deceased's body were described during the autopsy. The medical reports in the case of the deceased - MDA and Soroka Hospital - were reviewed, as well as the findings of the toxicological examination that was performed on him, and the findings of the knife test that was transferred for examination were detailed.
The body of the deceased contained "more than 120 cut and stab wounds on the upper body."
