Her testimony was heard in court at a hearing on November 29, 2022.  During the hearing, the witness reiterated the main points she had made in a statement to the police, and added that she also lives in Netivot.  In her estimation, the distance from her home to her grandmother's house is half an hour on foot, and fifteen minutes by car.  In her cross-examination, she replied that she was not in contact with Riki, the deceased's mother (who is the ex-wife of her brother Shimon), and denied that she had shared any information with her about the relationship between the defendant and the deceased.

  • Cousin of the defendant and the deceased, Daniel Sarahsher, A.T.13 - his statements were submitted to the police on 29.03.21 (P/38) and of 11.04.21 (P/39 and P /39A); the transcripts of the interrogations (P/38A and P/39B, respectively); the CDs documenting them (P/38B and P/39C); as well as a report of a confrontation between the defendant and the witness Daniel Sarahsher, dated April 11, 2021 (P/40); transcript of the confrontation (P/40A. identical toP/6A); and a disc documenting it (P/40B.  Identical toP/6B).

At the beginning of his first statement, the witness spoke about the time he and his brother Eliran spent time together with the deceased, the night before the incident.  According to him, Ben did not look good inside, "as if he felt like he was going to die," but said that everything was fine (Q.  66.  He also reiterated this in his testimony in court, at p.  588).  During the evening they drank alcohol, but not much, dropped Ben off at his grandmother's house, at about 5:30 A.M., and continued to their home.  At around 9:35 A.M., his mother called to wake them up, and they drove, at her request, to the grandmother's house.  When asked about the nature of his acquaintance with the defendant, the witness replied, "He is my uncle, he was also detained for 3 and a half years for stabbings, the relationship between us is peace, we were not in the best relationship, I wouldn't get along with him, he was released from prison because he stabbed Ben's father, but Ben forgave him for that" (Q.  35-36).  Regarding the relationship between the deceased and the defendant, he said, "There were arguments between them about things about the family, which have hatred between them since childhood, and this is something that got worse over the years, they would also work together but didn't get along." He also said that the deceased had two phones in his possession, an iPhone and a Galaxy (Q.  98).  In his second statement, the witness reiterated the main points he had given in the first interrogation, and insisted (when he was presented with the defendant's version shortly after the incident, that he was supposedly involved) that he was not present at the scene at the time of the incident, but rather slept at home and arrived at the scene with his brother only when the mother called them.  At a certain point, when asked why the defendant would give his name, as someone who was present at the scene, he replied, "I don't know why he spewed out my name.  You saw that the policeman was telling him that" (P/39A, s.  5.  Later on, it appears that the defendant adopts this thesis for his later version).  In the confrontation with the defendant, the witness did not cooperate with the investigators (similar to the defendant himself, and on this below), and beyond stating that he was not present at the scene at the time of the incident, but rather at his home, he added nothing.
