The plaintiff claims that that night she continued to complain to the defendant about pain, and he suggested that she go for medical treatment, but she believed that it was a dry blow and that the pain would go away after rest. The next day, and in view of the fact that the plaintiff continued to suffer from pain, the defendant borrowed a private car from a friend in order to drive her to the train station, and did not ride her on the motorcycle to the bus station as he had done during her previous visits to him. The plaintiff returned home by taxi, and in the following days she made sure to rest, except for one day when she went to work and returned a few hours later, when she was informed that she was summoned to a hearing before dismissal.
- During her cross-examination, the plaintiff reiterated her theory at length. She described the course of the ride and testified that in the absence of signs in preparation for the passage, the defendant did not slow down the motorcycle ride: "As soon as we passed the stop, I just unplugged from the seat, I jumped, I flew in the air, that's how I estimate it, 25 centimeters, I climbed up my helmet and went up beyond the height of Otniel's helmet who was sitting in front of me, we passed the stop, it's a matter of 2, 3 seconds it was very fast in stopping as soon as I went up I just landed violently, I slammed, I didn't rest, I was slammed on the seat, if before then on the ride I was balanced and sat on a motorcycle like that on both buttocks so when I landed I felt like I had landed on the left buttocks as if I had also lost a little bit of my concentration on the seat, most of the blow was in my left buttocks, I immediately gave a scream I gave a few screams as if I gave a strong one that he noticed and after that a little more of the pain, After we passed the stop, or rather, when we finished passing the stop, we had another small movement, and I felt it due to a small movement in the motorcycle..." [Prov. lines 9-20 on p. 9].
The plaintiff testified that after jumping while driving on the cattle crossing, there was another small movement when returning to the asphalt. Hearing the plaintiff's scream, the defendant asked, "What happened?" and whether there was a need to stop, and the plaintiff asked him to drive slowly. Due to the fact that there was no place to stop on the side of the road, the two continued to drive as far as the observatory. When they got off the motorcycle, she told the defendant that she had been hit hard in the buttocks, and tried to walk in order to understand her condition. A short time later, the plaintiff asked to return to the defendant's home and forgo the planned trip, so that she could rest and take painkillers. The plaintiff claimed that they stayed there for a short time of 20 or 30 minutes, walked several dozen meters on a paved road, sat down in the plaza of the observatory, and then returned to the defendant's home.
