Later, the plaintiff described that she continued to suffer from pain at the defendant's home and could not fall asleep at night, and the next day the defendant took her in a car borrowed from a friend and drove her to the train station, after which she returned home in a taxi.
- As to the incident itself, the plaintiff replied that the ride was on a flat road and not uphill, when in her estimation the speed was about 60 km/h. The plaintiff demonstrated the height to which she rose when the motorcycle jumped, and estimated that it was 20-25 centimeters. During her cross-examination, the plaintiff was referred to what was stated in the orthopedic expert's opinion, who noted that she jumped about 40 centimeters above the seat, and replied that she did not give a numerical figure, but rather demonstrated to the expert the height of the jump in her estimation, as she also demonstrated in the courtroom.
The plaintiff confirmed that there were speed bumps and other disruptions on the road, but these were minor disruptions, when after the shock and the blow she received, the defendant made sure to drive at a low speed, stopped in front of the cattle crossings that were further down the road, and passed over them very carefully on the metal strip along them.
As to the location of the ride on the cattle crossing, the plaintiff testified that the motorcycle was traveling in the center of the crossing, and that the height of the step that caused the jump was about 8 or 9 centimeters, and she had no explanation for the fact that the expert on her behalf also determined that the height difference between the metal and the asphalt in the center of the crossing was smaller.
- The defendant claimed in his affidavit that the trip to Mitzpe was conducted routinely and without an unusual incident, when during the motorcycle ride together with the plaintiff they passed through a number of cattle prevention crossings, but the plaintiff did not complain of bruising or pain during or after the trip. The defendant clarified that during the ride there was no jump or fall of the motorcycle or from it, and that if there had been a jump as described by the plaintiff, it would have caused the motorcycle to fall. Driving on a cattle drive is similar to driving on a paved road, with no significant fluctuations.
The defendant denied the plaintiff's version and claimed that she was born for the purpose of the lawsuit. In practice, the two continued the trip as planned, hiking and climbing the area on a hiking and climbing trail in off-road conditions for about half an hour, and then rode back to the defendant's home, a 20-minute drive, with the plaintiff not complaining of bruising or pain, even though the road was paved with speed bumps. The defendant claimed that there was no unusual incident at his home either, and that the plaintiff did not complain of pain, and returned home at the scheduled time the next morning.
