Defendant 9 [hereinafter: "Adv. Amjad"], Mona's husband, managed the Razi Company.
The plaintiffs claimed that Adv. Amjad provided Sol with legal services in the preparation of the transaction regarding the Nahalat Binyamin café, which was not executed, and also in the matter of the transaction with the Rothschild Café Partnership, which was made close to the Nahalat Binyamin café transaction.
Adv. Amjad claimed that he represented the plaintiffs in the Nahalat Binyamin café deal [not related to the Rothschild coffee chain], but in the Herzliya café deal [which is connected to the Rothschild café chain] he represented only the partnership.
Defendant 10 [hereinafter: "Attias"] provided Sol with brokerage services in the preparation of the transaction with the Rothschild Café Partnership, within the framework of the Razi Company.
Defendant 10 was in insolvency proceedings, and was brought to the attention of the court by his attorney, who was given the insolvency court's approval to manage the claim against him [see the notice of counsel for defendants 7-10 at p. 6 of the transcript, lines 22-23].
- On June 14, 2016, the Rothschild Café Partnership gave notice to Sol regarding the cancellation of the franchise agreement [Appendix 23 to the claim].
Regarding this notice, counsel for the partnership in the pre-trial stated on page 10 of the transcript line 2: "Our version is that the concession agreement ended on December 31, 2016, and was not canceled."
On June 16, 2016, Sol gave notice to the partnership of the cancellation of the concession agreement and the sale agreement [Appendix 24 to the claim], after Sol sent a warning to the partnership on May 9, 2016 prior to the cancellation of the agreements [Appendix 22 to the claim].
On July 31, 2015, possession of the café in Herzliya was handed over to Sol [clause 5.1 of the sale agreement - Appendix 18 to the claim].
On December 31, 2016, Sol vacated the café, after a judgment was issued against it for eviction in the Magistrate's Court in Herzliya [CA 1392-07-16].
