"For the low side case, we estimate a 4 percent total porosity composed of a 3 percent matrix porosity and a 1 percent fracture porosity. For the high side case, assuming that the carbonate is dolomite and not limestone, we estimate a 10 percent total porosity composed of an 8 percent porosity matrix and a 2 percent fracture porosity".
The parties disagree on the significance of what is stated in the first resource report. On behalf of the plaintiff, it was claimed that the reported pore rates are 4%-10%, while the defendants claim that this figure includes the cracking component, and the relevant figure in our case, which relates only to pores, is 3%-8%, which is the pore figure without the cracking component (paragraph 10 of the plaintiff's summaries; paragraph 50 of the Levy 3 affidavit).
It should be emphasized that from the aforesaid it emerges that even if we assume the defendants' position that the independent values of the pores are 3%-8%, this means that alongside a figure that includes the cracking component, the pore data in their "independent" values were also published in the first resource report. Admittedly, the two data report together, which supports the defendants' claim that the overall conclusion regarding the chance of oil production derives from both together. At the same time, the score of the independent values of the pores shows that this figure is also significant.
- As mentioned, in the electrical log tests carried out at the "Yam 3" drilling, a porosity figure of 2%-6% was obtained, which is a lower rate than that noted in the first resource report.
- Levy stated that on September 7, 2013, when the results of the electrical logs tests were received, a meeting of the Operations Committee was held (paragraph 94 of Levy 3's affidavit). This committee was established for the purpose of supreme supervision of drilling activity, its members were representatives of the partners in the license, and it was accompanied by consultants from the field of geology, engineering and drilling, who were hired by the companies (paragraphs 29-30 of the Levy 1 affidavit, paragraphs 82-88 of the Levy 3 affidavit, the minutes of the meeting (Appendix 6 to the statement of defense)). We learn from the affidavit of Levi who was present at the meeting, and from the minutes of the meeting. Shemen's chief geologist and consultant, Chuck Dummer (hereinafter: Domer), explained that the highest porosity rate in the reservoir is 6%: "Highest primary porosity in the entire reservoir is up to 6%", added data regarding the rate of water saturation, and also referred to the thickness of the layer:
"Net pay is estimated differently as different porosity cut parameters were used. Based on larger than 1% porosity net pay is 68m and represented most likely by light oil…"
