In Muhammad's testimony in court, Muhammad said, "The relationship I had with Marwan is first and foremost a relative..... And the business that was between us was that we would bring hydro and this one, selling" (P. 14.2.22, p. 258).  Muhammad confirmed that Marwan's father and father and Defendant 2 were brothers, but he also confirmed that he was less in contact with Defendants 2 and 3 (ibid., p. 259).

Defendant 2, for his part, told the court that the relationship between Muhammad and his brother Marwan was about joint drug business (F. of December 26, 2022, p. 348).  According to him, in June 2019, his brother was stabbed (ibid., p. 347, para. 10), and a month later he died after being hospitalized (ibid., pp. 348, para. 10).  According to the description of defendant 2, during his brother's hospitalization, Muhammad began to arrive at the hospital and get closer to his family, and at a certain point he came to him with an offer to bring "hydro" bags from Be'er Sheva : "I bring you, you will disperse, but come and collect it from Beersheba" (ibid., p. 350, para. 7).

It should also be noted that a perusal of the dubbing conversation P/20 in which Muhammad tells the informant that when he was little, his uncles wanted to destroy his father, and he noted that even today he does not talk to his uncles.  Muhammad further confirmed to the informant that defendant 2 was a friend of his uncles (P/20A, p. 2, line 26 to p. 3, line 12).  All the facts presented will show that the state has not been able to present a real close relationship (other than a kinship) between Muhammad and Defendant 2, who was supposed to bring Defendant 2 to assist him in a murder operation.

Defendant 3, for his part, tells the court that he has no personal contact with Muhammad at all, and that the acquaintance was only made in the hospital near Marwan's bed after his injury.  (P. of March 21, 2023, pp. 280-281).

As for Defendant 3, no real connection was presented between him and Muhammad that would present any motive for Defendant 3 to assist Muhammad or Defendant 2 in the murder of the deceased.
