Muhammad's second testimony of 14 February 2022 - At the request of counsel for the defendants, Muhammad returned to the witness stand on 14 February 2022, after he testified before the panel that heard his case. The court granted Muhammad immunity in accordance with section 47b of the Evidence Ordinance against self-incrimination, and allowed him to speak about the events that are the subject of our discussion without fear. Even after the court granted Muhammad the aforementioned immunity, Muhammad chose not to respond to the plaintiff's questions on the matter, and only after the conclusion of his interrogation by the prosecutor began to answer the questions asked by the defense attorneys.
There is no substance in the defense's arguments that Muhammad refrained from answering the prosecutor's questions because he did not understand the meaning of immunity, or because he feared that the accuser would use his words against him. Even at the beginning of his interrogation by the defense, Muhammad refused to answer the questions, but within a very short time he began to answer the defense questions in a substantive manner and continued to do so until the end of his testimony. In the circumstances of the case, it appears that Muhammad was not particularly affected by the fact that he was not interviewed or prepared to testify, and that his conduct was influenced by an orderly plan that he had planned, according to which he would only answer the defense's questions.
It is not surprising that Mohammed's conduct in court is not surprising, and it can even be said that as far as he is concerned, it was even "legitimate" in the circumstances of the case. Muhammad is a relative of both defendant 2 and defendant 3 and is a close friend of defendant 1, and in contrast to other cases in which tension is sometimes evident between accomplices to the offense according to an indictment, which the events of the indictment or other events made them have conflicting interests, Mohammed's answers to the defense representatives' questions were on the face of them answers that the defendants expected to hear from him. who backed up their version in one way or another. Thus, Muhammad confirms the version of the "drug plan" presented by the defendants, and testifies that he was the central person in that plan and that the defendants themselves were not informed of the plan in its details (P. of February 14, 2022, pp. 237, 238, pp. 240, 241, p. 260, paras. 21-27).
