Conclusions Regarding Defendant 1
In all the circumstances of the case, as detailed in detail above, and in light of the accumulation of evidence against the defendant and its great strength, it must be determined (as alleged in the indictment) at a level that is beyond a reasonable doubt, that defendant 1 together with Muhammad killed the deceased, in cold blood, after he decided to kill him without the frequent provocation of the act, in circumstances in which he could think and understand the consequences of his actions, after he had prepared himself for it. Together with Muhammad, he prepared the murder tool with which he killed the deceased. Defendant 1, in these acts, together with Muhammad, caused the death of the deceased intentionally, after planning or after an actual process of weighing and formulating a decision to kill him.
Defendants 2,3
These are the defendants who actually confessed to all the events detailed in the indictment, and the only dispute in their case is whether they knew about Muhammad's intention to murder the deceased and whether they acted with that knowledge, or whether their actions stemmed from a different intention of bringing drugs to the center of the country that is not an intention to murder.
Defendants 2 and 3 do not deny the fact that Defendant 2 traveled to the Occupied Territories in order to receive a car, a few days before the murder, they do not deny their joint trip on the day of the murder to the "Dor-Alon" gas station in the settlement of Lakiya, in meeting with Muhammad and Defendant 1 at the gas station, and later in arriving at the "meeting point" in the area of the settlement of Hura with Muhammad and Defendant 1 and on their joint trip back to Lod, but their claim was that their behavior was not intended to murder at all. Rather, it was intended to bring drugs from the south to Lod in order to sell them later.
The point of contention between defendants 2 and 3 and the accuser relates to the denial of defendants 2 and 3 that they had conspired with Muhammad to murder the deceased, and their claim is that Muhammad approached defendant 2 a few days before the murder with a proposal to steal drugs from a person in the settlement of Hura. Defendant 2 admitted that he had traveled with Muhammad to the Occupied Territories so that Muhammad would have a car for the purpose of carrying out the drug theft plan, but denied claiming that he knew that a murder would be carried out by means of the vehicle. Defendants 2 and 3 confirmed that they had spoken with Muhammad and Defendant 1 at the Dor Alon gas station in Lakiya, but claimed that the conversation was about the theft of drugs and did not touch on the murder, and later they arrived at the "meeting point" under Muhammad's direction, but denied that they had set fire to a vehicle before leaving the scene and before driving together with Muhammad and Defendant 1 back to the city of Lod.
