Discussion – An examination of the aforesaid words of Muhammad to the informant shows that from Muhammad's aforesaid words it is not possible to conclusively learn about the knowledge of defendant 2 about the murder. First, it should be said that immediately after the words "I sat with him when I came," Muhammad adds an entire sentence that was not understood by the receiver, "(an unclear sentence)", and therefore it is difficult to give a clear interpretation of a statement that is only half of a sentence. Moreover, defendants 2 and 3 did not dispute in court about their sitting with Muhammad at the Dor Alon gas station, but stated that they talked about drugs and that their claim should be examined.
In addition to the above, it should be noted that to the informant's question about what he knew about you, Muhammad replied with the words, "I sat with him," and he did not say to the informant, "What do you mean?" He knows everything about me, because we sat together, talked about the murder and summed things up. Muhammad's answer was more limited and did not go into more detail than the fact of the meeting with Defendants 2 and 3, and it is possible that Muhammad's intention in his words was to say that Defendant 2 knew that they were sitting together at the gas station, (and he also knows that Muhammad later went to the settlement of Hura) so that he could tell the police about it and advance the investigation against him.
Above all, an examination of the details of the above conversation reveals that immediately after the above, the dialogue between the two continues as follows:
