Defendant 2 "knows" about the murder or "knew" about the murder – another statement in Muhammad's words to the informant, to which counsel for the parties referred in their summaries, related, as stated, to Muhammad's statement to the informant that defendant 2 "knows" about the murder. Thus, during the dubbing conversation, a conversation took place between Muhammad and the informant about Defendant 2, known as "Beauty Beauty" and about the seizure of the weapon and the burning of the car, during which the informant asked Muhammad, "If he wants to open it, he opens it" and Muhammad replies, "He's behind me, he won't come before me," and then the informant asks:
"Detainee No. 1, known as "Bilal Rayan": But does he know that you are the one who murdered him?
Detainee No. 2, Muhammad Assiwi: Oh (yes) (what is stated in parentheses "yes" is handwritten and agreed upon – A.H.). "
Detainee No. 1, known as "Bilal Rayan": He knows?
Detainee No. 2, Muhammad Assiwi: Ahh..."
As can be seen from the above conversation between Muhammad and the informant, the informant asked Muhammad when he was talking about Defendant 2: "But if he wants to start, what does he start with?And Muhammad replies, "He's behind me, he won't come before me," and when the informant asks him, "But does he know you murdered?" Muhammad replies, "Oh (yes)." (P/20A, p. 5, s. 5-9).
According to the accusing counsel in their summaries, it appears from the aforesaid that Muhammad understands that the informant asks whether defendant 2 can incriminate him regarding the murder, and he replies to the informant that defendant 2 can incriminate him because he knows about the murder. According to the accusing counsel, Muhammad would not have imagined that Defendant 2 could have incriminated him in connection with the murder, if he had not been involved in the murder, and his knowledge was late in the murder. According to the accuser's counsel in their summaries in his testimony in court at the hearing of January 10, 2023 (pp. 367-370), defendant 2 did not give a satisfactory explanation on this matter, but evaded his answers.
