Judgment

 

  1. In this lawsuit, we dealt with a lawsuit by FBC Technologies against 7 of its former employees, for compensation for breach of the duty of confidentiality and theft of trade secrets, solicitation of employees, breach of the duty of loyalty and the duty of good faith, and breach of employment agreements in the amount of NIS 1.7 million. We also discussed the employees' claim against the company for compensation for bullying, defamation, and other NIS 700,000.
  2. We will present below the undisputed facts, the arguments of the parties, describe the main part of the hearing that took place, and detail the court's decision.

The facts that are not in dispute between the parties

  1. The plaintiff and the counter-defendant are a company of the One Technologies Software in Tax Appeal (ONE) Group, which is engaged in providing solutions and support in the field of priority (hereinafter: the "Plaintiff" or the "Company" or "FBC").
  2. The defendants and the counter-plaintiffs (hereinafter: the "Employees") were employed by the Company in the following positions and periods:
  3. Ms. Coral Gavli (hereinafter: "Ms. Jabali") was employed by the company as an implementer and project manager from January 13, 2021 until March 24, 2022;
  4. Ms. Hila Karko (hereinafter: "Ms. Karko") was employed by the Company as a Priority Implementer from January 31, 2021 until March 24, 2022;
  • Ms. Oshrat Shachar Nash (hereinafter: "Ms. Nash") was employed by the company as a project manager from November 22, 2020 until December 7, 2021;
  1. Mr. Renen Kahlon (hereinafter: "Mr. Kahlon") was employed by the Company as a priority implementer from December 13, 2020 until January 31, 2022;
  2. Mr. Yaniv Ganem (hereinafter: "Mr. Ghanem") was employed by the Company as a priority implementer from December 1, 2020 until December 1, 2021;
  3. Mr. Yaniv Yosef (hereinafter: "Mr. Yosef") was employed by the company as a project manager from November 20, 2019 until May 24, 2022;
  • Mr. Or Elhanati (hereinafter: "Mr. Elhanati") was employed by the Company as a priority implementer and project manager from July 12, 2020 until December 16, 2021;
  1. The employees have signed employment agreements with FBC in which they undertook, among other things, confidentiality, non-competition, and non-solicitation.
  2. After the employees terminated their employment with the company, they began working at Mediatech Technologies in Tax Appeal (hereinafter: "Datatech"), which is also engaged in the priority field.
