It should be noted that both Kobi Zoaretz and Avi Ben Nissan were listed on the list of prosecution witnesses, but the plaintiff's statement indicates that the prosecution was unable to locate them and summon them to testify, and in the end they were summoned by defendant 4, Avi Kalmaro.
In their extensive summaries, counsel for defendant 1 argued that no credence should be placed in the testimony of Kobi Zoaretz and Avi Ben Nissan, who are criminals, who were convicted of a long list of offenses, and who have a real interest in incriminating defendant 1. It is worth mentioning that Defendant 1 even claimed that during the interrogation, while he was in the corridors of the Customs Investigation Offices, an anonymous person approached him and warned him not to mention the names of Kobi Zoaretz and Avi Ben Nissan as connected to the affair, and for this reason he did not mention their names.
Indeed, these are large transparent witnesses of vermin hanging behind them, and they were convicted of various offenses, including fraud and impersonation of others, but in the case of the Savilla company (as well as the Danidov company), I saw no real reason not to accept their version.
Throughout the indictment, Swela Trading Ltd. appears as a company that supposedly manages import transactions on a very large scale, and based on the direct impression of the two witnesses, I am of the opinion that there is no substance to the claim that they are the ones behind those transactions. Defendant 1's version in this matter, according to which the Sevilla company was never under his control, and that the testimony of Pinchas Basson, the company's bookkeeper, in this matter should not be trusted, is not acceptable to me, at all. I have already expressed my opinion about the reliability of Pinchas Basson, as far as JCC and ICT companies are concerned , and the same is true of Sevilla.
I reiterate that defendant 1 impersonated Pinchas Basson as Haim Zaruk, and appeared as the person who manages the three companies, and as the person in charge of their financial affairs. I categorically reject the unreliable version of Defendant 1, according to which he knew Kobi Zoaretz and Avi Ben Nissan through Defendant 4: "as businessmen interested in carrying out financial transactions through companies under their management, such as Sevilla, in order to obtain a volume of transactions and to obtain volumes of credit."
