The prosecution also referred to a memorandum about a conversation between Defendant 1 and the investigator Effi Ezer (P/419), which indicates that Defendant 1 filled   out tax appeal reports of the Danidov Company and submitted them to the Postal Bank in Herzliya, with the signature, allegedly, of Avraham Staggovsky.  According to Defendant 1: "He filled out the reports and submitted them because Avi Stavitzky told him that Sztgowski was not in Israel."

Needless to say, no evidence has been presented that the same Avi Stavitzky exists in reality, and there are grounds for the prosecution's argument that he is a fictitious figure.

In addition, the prosecution pointed to the fact that Avraham Sztgowski's name appears in the diary of defendant 1 (P/363), without giving a real explanation for this.

It is also worth referring to the statement of defendant 1 (P/321) dated 30.10.2000, in which defendant 1 claimed, inter alia, that Elhanan Tenenbaum was the man behind the companies Schloss, Svila and Danidov.  He also claimed that the same anonymous Avi Stavitzky is Elhanan Tenenbaum's emissary and represents him regarding these companies.

There is no dispute that these statements of defendant 1 are completely false, at least as far as the companies of Savilla and Danidov are concerned, and the only explanation for the incorporation of these companies in the context of Elhanan Tenenbaum lies in the fact that Tenenbaum was, at the time, held captive by Hezbollah, and therefore defendant 1 saw no impediment to throwing on Tenenbaum's shoulders various issues and activities that were not related to him.  In general.

During the trial, Defendant 1 claimed that the person who presented himself as Avi Stavitzky was in fact Avi Ben Nissan, and that he only learned of this after the indictment was filed.  In the same way, Defendant 1 referred to Avi Sztgowski as the same Avi Ben Nissan.

It can be determined, on the basis of the totality of the evidence presented to me, that the name Avi Stavitzky was raised by Defendant 1 without him meeting a person with that name, and needless to say, that Avi Stavitzky did not act on behalf of the companies Svilla and Danidov, and certainly did not represent Elhanan Tenenbaum in this matter.
