I have already noted that Tenenbaum has been granted full immunity from prosecution, insofar as the offenses he committed in the past, and it is unacceptable that he would have concealed his part in the affairs that are the subject of the indictment, had he been involved in them in a criminal way. Despite Elchanan Tenenbaum's burdensome past, he should not be attributed to a lack of wisdom or a lack of understanding of reality, and as far as he was concerned, it would have been an act bordering on suicide, if he had tried to hide his part in the offenses he committed, when any lie would have led, in the end, to the cancellation of the agreement with him. Elhanan Tenenbaum even went further in his testimony when he claimed that he told the whole truth in full about offenses he had committed in the past, including the fact that in the eighth grade he participated in stealing oranges from an orchard, and even if these words were exaggerated, I consider accepting his claim that he revealed his entire negative past to his interrogators.
On the basis of an examination of the matter, I have reached the conclusion that the statements of Defendant 1, according to which Elhanan Tenenbaum was involved in the execution of the transactions described in the indictment, in whole or in part, should not be trusted, and I am of the opinion that Elchanan Tenenbaum's statements in this context are reliable and worthy of trust.
Another factor named in the 9-14 indictment is the Arab merchant who goes by the name Karim Bakir, who allegedly operated on behalf of the Mand-Electric company. I have already noted in my previous remarks that no real evidence has been brought that such a person exists in reality, or that he is connected, in one way or another, to the transactions described in the indictment. Similarly, I was not persuaded that there was a company called Mand-Electric, and no evidence was brought regarding the existence of this company.
Counsel for Defendant 1 made every possible effort to summon witnesses, in order to support Defendant 1's version, including witnesses from abroad, such as the mysterious Vincent Lo-Duque, but for some reason they did not bother to summon Karim to testify, or to provide details that could be used to locate him and summon him to testify.
