The fact that defendant 1 is behind the Schloss company, he and no one else, can be learned from the testimonies of the various customs brokers, who handled the release of the goods, which are the subject of charges 1, 2 and 9. Thus, for example, Yehuda Bachtizan, who handled the release of the goods that are the subject of the first indictment, and Roni Moshe, who handled the release of the goods that are the subject of charges 2 and 9, testified on this issue.
Rafi Naim, an accountant at Mentfield, was asked about the handling of Schloss, and testified that : "Schloss is a company that worked with us. We released files to them" (p. 235 of the transcript, s. 16).
The witness said that the contact with Schloss was made through Uri Resch, who "contacted us in order for us to release the company's cargo" (Q. 23).
To the question of whether, other than Uri Resch, there was another entity that handled the affairs of Schloss, the witness answered in the negative.
Through the witness, the bookkeeping card relating to Schloss was submitted, on which the name Uri Resh and his telephone number appear (P/53). The tax invoices produced by Mentfield for Schloss (P/54) were also addressed to defendant 1, when the amounts of the invoices were not paid from Schloss's bank account at Mizrahi Bank, but from another account at Discount Bank.
In this regard, it is worth mentioning that the goods, which are the subject of charges 1 and 2, were released by means of registers submitted on behalf of Schloss, while it is known that Schloss had no substantive connection to these goods.
At least with regard to the first container, which is the subject of the first indictment, defendant 1 confirmed, in his statement of May 18, 1999 (P/302), that he was the one who handled the release of the container, using the licenses submitted on behalf of Schloss to the Mentfield company, which handled the release of the goods.
The prosecution also points to the words of Shlomo Metuk in his statement of 06.12.2000 (P/276), which was accepted as evidence of the content. Regarding the invoices of the Schloss company, Shlomo Matuk said : "Uri Resch would deliver an invoice book in Schloss's name and I would write an invoice for the customer in a transaction that was acceptable to Uri Resch."
