There was no dispute, as stated, that Jan Schwartzman and Meir Ben Shimon did not sign the incorporation documents of the companies JCC and ICT, although the prosecution admits that it "did not succeed in proving who actually forged the signatures with his own hands and pen."
Natan Harpaz testified that the person who approached him, asked to establish the aforementioned companies, and gave him the names of the founders, as it were, was Yehoshua Shlosh, and in the case of this defendant, I will discuss in the framework of the separate judgment.
The prosecution attributes criminal liability, in connection with the establishment of the JCC and ICT companies, to defendant 3, Araldo Friesi. According to the prosecution, Meir Ben Shimon's name was given to defendant 1 by defendant 3, and the same applies to the name of his ex-wife, Lucien Sadeh. The prosecution notes that Meir Ben Shimon was a shareholder in Forum Office Ltd., through which the orders that are the subject of charges 4-7 were executed, and through this company (Forum Office), it was possible to produce his personal details. On the other hand, the details of Ms. Lucien Sadeh do not appear in these documents, and it is reasonable to assume that these details were given to defendant 1 by defendant 3.
During his interrogation, Defendant 3 denied that he had given Defendant 1 the personal details of Meir Ben Shimon and his ex-wife, but according to the prosecution, he admitted this in his recorded conversation with Yehoshua Chelouche (S/124D), saying: "Uri, one day he says, Aldo, you know someone he could be... How do you read... A company manager, I told him I have a friend, that he doesn't work, maybe if he earns some money every month, I sent his ID card to Ori, after that Uri tells me, he's not suitable for me. I said, 'Well, thank you.'"
In addition, the prosecution refers to Exhibit 333, which documents a one-on-one conversation between defendant 3 and a police investigator, in which defendant 3 claimed that Ben Shimon and his ex-wife voluntarily handed over their identity cards, in order to open a company in their name : "As for the suspects Meir Ben Shimon and Lucien Sadeh, he stated that they knew that he was going to open a company in their name and they voluntarily gave him their identity card because of this. According to him, he also passed on the details of this company to Uri Resch."
