As to the forgery of Jan Schwartzman's signature, the prosecution agrees that it has not been able to prove from where Yehoshua Shlosh and defendant 1 received the name and personal details of Jan Schwartzman, whom they registered as a shareholder in ICT and JCC. Jan Schwartzman himself does not know how his name came to the defendants, and he does not know any of them.
According to the prosecution's approach, Yehoshua Chelouche and Defendant 1 can be linked to the disclosure of the name of Jan Schwartzman, since they are responsible for the fraudulent registration of the companies, and they are the ones who controlled them, from the beginning. In support of this claim, the prosecution pointed to the statements of defendant 4, Avi Kalamaro, in his statement to the police P/338, where he mentioned Jan Schwartzman in the context of JCC, which indicates that he heard this detail from defendant 1.
In addition, the prosecution mentioned the involvement of defendant 1 in forging the founders' signatures, as far as the Merig company is concerned, which indicates the method used by defendant 1, also in the context of other shell companies established by him.
Even without referring to the mention of the name of Jan Schwartzman by Defendant 4, and to the fact that Defendant 1 was involved in forging the signatures of the founders of the Merig company, it can be determined that Defendant 1 was involved in the transfer of the personal details of Meir Ben Shimon and his ex-wife Lucien Sadeh to Yehoshua Shlosh, for the purpose of registering the ICT and JCC companies in their names. Thus, he should be seen as the main criminal in this affair, together with Yehoshua Shlosh.
After determining that the names and copies of the identity cards of Meir Ben Shimon and Lucien Sadeh were received by Defendant 1 from Defendant 3, based on the latter's knowledge that this was intended to establish companies that would serve Defendant 1, Defendant 3 should be regarded as an assistant to the commission of the offenses attributed to Defendant 1.
