In contrast, we are dealing with a situation in which the committee has not been able to remedy the flaw in its activity. Therefore, from my point of view, the appropriate remedy at this stage is focused on the committee itself. Since I remained in the minority, there was no longer any possibility of correcting the difficulties described in detail - But it is also not possible to plant rivets in relation to the dispute on the question of the purity of the virtues on its merits.
- I will add that from the outset, the tight timeline was a shadow that hovered over the proceeding. At the same time, the utmost effort was made on the part of this court to enable the completion of the necessary steps within a short timetable. Indeed, we have allotted the committee a period of time to complete its work. However, there was no impediment to the committee itself deciding on the summoning of additional parties, nor was there any impediment to requesting a short extension to complete the process. The committee chose not to do so after repeatedly noting all along that it was strengthening its opinion. If the committee had acted differently, it would have benefited, among other things, General Goffman himself.
- If so, and although I agree with the principles presented in the opinion of my colleague Justice Grosskopf, I cannot join his operative conclusions in the circumstances of the case before us, except on the question of costs.
- In our sources, the phrase "There is no joy as the removal of doubts." In light of the parasha in the background, there is not much joy in the case before us. However, there is certainly a great benefit - for all parties - in a full clarification of the facts. In my opinion, there is an obligation to dispel doubts here.
