In the annex to the email that Shachar sent to Naveh, almost simultaneously with Shachar's message to Gilad, Shahar stated prices of $7,790 per unit for one type of server (server 336) and $8,270 for the other type of server (server 346) (P/538, P/22).  Shachar testified that he sent the prices to Naveh so that Naveh would send them to Kinturk Malta (p. 2725, paras. 1-12).

It is easy to see that the prices mentioned by Shachar both in the message to Gilad and in the notice to Naveh are higher than the prices of Wie's offer in relation to each type of server, so that the prices of Harel and Triple C will be higher than the prices of Wie's offer, which will be the cheapest (Wii prices are mentioned in paragraph 352 above).

  1. As we will see right away, Gilad and Naveh submitted proposals in a manner that matched what Shahar sent them.
  2. For the sake of completeness of the factual description, it should be noted that on 10 June 2010 and 13 June 2010, there was additional correspondence between Kinturk and Gilad Maharel. Kenitork tried to get Harel to submit a price quote to the Anemone Division in accordance with the Comptroller General's Agreement (N/36), that is, at preferential prices.  Gilad replied to KinTork that after a conversation with Peretz, head of the server procurement and communications department at Maman, it was agreed that the servers that are the subject of the communications agreement do not fall within the scope of the Comptroller's agreement (P/37, P/408, Peretz writes in a copy of the correspondence).  Knitork testified that it was Peretz who raised the request to receive an offer from Harel by virtue of the Comptroller General's agreement (p. 465, paras. 13-25).  Even if, as Harel claims in its summaries, there was no basis for the purchase request to receive a bid in accordance with the Comptroller General's agreement, Knitwerk's appeal and the attempt to urge Harel to make such an offer clearly show that Knitwerk tried to obtain the best true offers.
  3. On June 14, 2010, Gilad and Naveh submitted to Knitürk the price quotes of Harel and Triple C for the BLM of Anemones (P/54, P/260, P/23; Kniturk, p. 348, paras. 21-24).

Gilad submitted Harel's offer to Kinatork in accordance with the prices that Shahar had sent him (P/54, P/260).  In the email message that Gilad sent to Connecticut, he noted that "the offer is based on prices I received from Altrade" (P/260, in the body of the offer it was stated that the products were in "new condition" and that delivery would be made within 21 business days).  Harel's total bid amounted to approximately $560,000, which is significantly higher than Wie's bid (this sum is obtained from the summary of all the components of the proposal, P/54; in Table P/50, Knitork stated a total of about $600,000 for Harel's offer; the differences stem from the manner in which the liability components were taken into account).
