The Request for Quotations and the Coordination Arrangement

  1. On June 7, 2010, Knitürk was appointed by the Elta Procurement Committee to conduct negotiations for the purchase of the equipment required for the Anemone Project (P/51). In the letter of appointment, it was noted that the form of engagement was "competition between suppliers" (there, in the line of notes, it was noted that this was the purchase of equipment that was not new in order to fit the existing configuration of the customer).
  2. On the same day - 7.6.10 - Knitork sent the request for quotes for equipment for the Anemone Project - it is in the Anemone Project. The companies were asked to submit a price quote for the equipment and servers listed (P/21, the bottom email correspondence is the sending of the request for a price quote to Shahar Moy; P/260, P/408, N/36, the bottom email correspondence is the sending of the request for a price quote to Gilad Maharel; as it appears from there, KinTork sent the request to Gilad again on June 8, 2010; see also paragraph 430 of the summaries of the Wii according to which the CBM was sent to the three companies,  including Triple C, even though the parties did not refer to evidence regarding the delivery of the UAV to Triple C).  In the upper left part of the request document, it was noted that the last date for a quote is June 10, 2010.  We will address the defense's arguments in this regard.
  3. The next day, on June 8, 2010, Shachar sent an e-mail to Gilad and Naveh in which he wrote: "My friend, Shlomi [Kniturk] informed me that yesterday the aforementioned [the Anemone Brigade] was sent to you. Please don't send anything, not even by mistake.  I will send you what to convey to Shlomi today" (P/21, underline added).
  4. A few hours later that day, 8 June 2010, and in direct continuation of the above, Shachar sent Gilad and Naveh e-mails with the prices he requested each of them to submit to ELTA in the price quotes on behalf of Harel and Triple C (P/53, P/538, P/22).

In the email to Gilad, Shachar wrote to him, "Send them these prices" and attached a file in which he mentioned prices of $7,290 per unit for one type of server (server 336) and $7,980 for the other type of server (server 346) (P/53).  Shachar testified that he expected Gilad to send Knitürk Malta what Shachar had sent him (p. 2724, paras. 12-24, for the sake of completeness it should be noted that, even earlier, and already on June 6, 2010, Shachar sent Gilad the price quote of Wey, P/52).
