Later on, we will address the arguments raised by the defendants on the basis of the position of the project's personnel and the reasoning of a single supplier. This includes the fact that ELTA Procurement was sovereign to conduct a bid and try to find out other procurement options even when a single supplier form was approved in the project. At this stage, it should be noted that the approval of a single supplier form is an internal procedure of ELTA, of the project party in Elta, and that this procedure was not visible to the suppliers (including the defendants) and the suppliers did not know about it at all (Oshri, p. 4741, paras. 13-16, it is clear that he did not know in real time and could not have known that he was a single supplier; Vered, p. 6409, paras. 23-24, the supplier does not know that the project issued a single supplier form; Naveh, p. 254, paras. 10-11, did not know the document; Kniturk, p. 346, s. 1, this is an internal IAI document).
On June 6, 2010, as stated above, the signing of the Single Supplier Reasoning Form (P/11) was completed.
At some point, apparently earlier, Shahar submitted a price quote to the project on behalf of Wee for a total of $440,530 (P/539, N/12, Shahar, p. 2729, paras. 20-22). The bid was based on a bid of $6,598 per unit for one type of server (server 336), and $6,864 per unit for another type of server (server 346). In the proposal that Shachar addressed to Rosenthal from the project, Shachar noted that the equipment was in excellent condition that until recently was in Intel's sterile server room, that the servers are in high demand and that at the request of Vered and Rosenthal – the project personnel at Elta – Wii will keep the servers for Elta for only one month (ibid.; since similar things were mentioned in the single supplier's reasoning form, it appears that Wie's proposal for the project preceded the form; the date printed at the top of the second page of P/51 is also mentioned, It contains details of a proposal by Wee, prior to the date of completion of the signatures on N/11).
