Moreover, the defense argued that the procurement personnel's request for quotations in a situation where the project approved a single supplier form was a fictitious bidding "for the record only". However, this argument is illogical. The approval of a single supplier form by the project left the procurement with discretion and it was possible to procure, if he saw fit, to promote an engagement with the single supplier and issue him an order later (on the basis of a single supplier exemption), even without holding pricing between different suppliers and without issuing a single supplier (Kniturk, p. 346, s. 8, Shkanevsky, p. 937, s. 22 - p. 938, s. 9; p. 1864, paras. 8-17, and see also s. 424 for the Wii summaries). From the testimonies cited above, it emerges that the "protocol" (i.e., IAI's procedures) did not obligate the procurement company to conduct a pricing and exit the IAI in such a situation. In any event, the argument that the selection of the procurement person to hold a competition and request price quotes, even though this is not required, was done "for the record" or that it helped in any way to expedite the completion of the procurement process (by means of non-obligatory pricing). This, too, supports the conclusion that arose from the evidence, according to which the exit at the IAI was done for the purpose of examining the truth of whether there are other alternatives (even if the probability of doing so was not high), in order to examine the price of the engagement, and in order to ensure an engagement under optimal conditions for IAI.
- The argument that in light of the approval of a single supplier, the pricing in Balam Anenot was fictitious should be rejected – we saw above that the approval of a single supplier by the project cannot justify coordinating price quotes and does not exclude the possibility that the procurement will seek to perform pricing and ask for price quotes. It appears that from the evidence that was brought it appears that the procurement had substantive reasons for requesting price quotes in the Anemone Division, the subject of the indictment, in order to examine the existence of additional procurement alternatives.
As stated above, the matter of the Anemone Alliance is in the purchase of old servers. Admittedly, the project located suitable servers in UltraTrade (with Wii's involvement). However, the testimonies indicated that by means of a request for quotations, the procurement company sought to examine the feasibility of additional alternatives, including whether there were additional inventories elsewhere; If it is possible to get a better quote for the stock found in Altrade; And check if the price offered by Wii is indeed the optimal price.
