Court Expert Opinion

  1. In the framework of the opinion, the court's expert made the following determinations:
  1. Construction defects that are the defendant's responsibility: There are construction defects in relation to the following components:

Dampness and sealing: dampness in the eastern wall of the parents' room.  Total estimated cost of the defect - 300 NIS.

Plaster, putty and paint: The expert found that the finish was defective in putty plaster and paint under the electrical cabinet, the scope of the electrical accessories in the safe room, the circumference of the rectangle of the window and the door of the safe room, and the parents' shower.  He also found that there was a local crack at the bottom of the bedroom window and between the service balcony and the bathroom, and that signs of paint leaks and brush marks were found around the openings of the air pipe in the safe room.  The total estimated cost of the defects is ILS 3,400.

Flooring and cladding: A defective tile was found in the entrance hall (during the period of the inspection of the flooring tiles); a defective tile was found in the dining area (during the period of the inspection of the flooring tiles); four tiles with unusual local scratches were found in the living room; a control box with a faulty cut and crack in the perimeter of the box was found in the living room; a single scratched tile was found in the master bedroom.  In addition, a local rifle crumbling was detected between the flooring joints in the balcony area and in the bathroom cladding, and it was found that no flexible separation joint was made in the seam line between the flooring and the cladding in the wet areas.  Tiles protruding from a plain were found in the bathroom bathtub wall, and it was found that the Niagara wall and the bathroom wall were poorly executed.  The total estimated cost of the defects is ILS 6,500.

Aluminum doors: The expert found a failure in the functioning of the living room display case, in the absence of the required locking, and there was a difficulty in the functioning of the safe room window.  The total estimated cost of repairing the defects was estimated at ILS 2,000.
