Needless to say, when Roy did not confirm that he was present at that conversation, we are dealing with hearsay-based testimony, with all that is implied.
When Roy was asked who David was a "monkey", he replied that David was Uri's "monkey", and testified that:
"The witness Mr. Edri: Uri brought a person, who told him that I need such and such a person, for society, I have duties, matters, here, there, everything I need. And you have to take care of a human being for me, it doesn't matter, I'm bringing you, you're going to take care of me for a person who will be a monkey. Apparently he did something with him under the table.
The Honorable Judge Yaron: With whom is it with him? Uri apparently did it with?
The witness, Mr. Edri: A people who don't know, what they call it, what was the name of this person? The means? That he told him?
Adv. Brook: Aharon. Leave the lawyer alone.
The witness, Mr. Edri: Aharon. Aharon is called him" (p. 44, lines 35-36 of the transcript and p. 45 lines 1-6 of the transcript).
When asked whether he could prove his claim that David was brought by Uri as a monkey, directly or
Indirectly, he replied: "I can't prove it. These things are talking. If not, we wouldn't
Standing here" (p. 45, lines 10-15 of the transcript).
If it is not enough that according to Roy's own opinion, the plaintiff has no proof of the claim that David served as Uri's "monkey", David confirmed in his testimony that he signed the agreement for the sale of the shares (p. 11, lines 24-26 of the transcript), and testified that he signed it on the orders of a man named Yisrael Aharon, who deceived him, and that he did not serve as Uri's "monkey":
"The witness, Mr. Ben Shalom: I put total trust in someone who deceived himself and me. He thought it was right for me to sign and take ownership of the company.
