He repeated this testimony later in his interrogation (p. 14, lines 27-31 of the transcript).
And later on:
"Adv. Brook: You claim that Ori is also as connected to your operation as you defined in your affidavit, Monkey?
The witness, Mr. Ben Shalom: No.
Q: Only Yisrael Aharon?
A: Yes" (p. 19, lines 28-31 of the transcript).
Given that David himself testified that he was not a "monkey" of Uri, but of another person, and taking into account that Roy testified that the plaintiff could not prove the claim that David was a "monkey" of Uri, and that no evidence was presented to support this claim, I hold that this claim was not proven by the plaintiff either.
- The plaintiff argued that in any event, in accordance with the agreement for the sale of shares to David, the Ministry of Health's funds, to the extent that they were received, were to "enter Uri's pocket", by transferring them from prestige to Weisbord Holdings and from there to him, but Uri stated that it was clear to him and David "that when the company receives any funds, the order of payments will be: repayment of debts to suppliers, payment to Uri Weisbord Holdings in accordance with the clauses of the sale agreement, and only afterwards will Mr. Ben Shalom be able to withdraw funds himself" (paragraph 46 of Uri's affidavit).
Uri was not questioned about what was said, and similarly, David was not questioned about what was said by the plaintiff.
Uri testified, as stated, that he assumed that David would exhaust the proceedings with the Ministry of Health and arrange payment
But in retrospect it became clear to him that his impression was wrong.
I will add that when Roy was asked whether he had approached Mr. Yossi Keinan with a request that the debt be paid, after receipts were received from Luxury, he replied, "No. I do not know" without providing a substantive reason for the statement (p. 53, lines 2-4 of the transcript).
- This is the place to address the plaintiff's claim that "despite the fact that he could have transferred payments to her, Uri chose to pay into his pocket directly and/or through third parties", and remained a director of prestige in order to control the funds received from the Ministry of Health, "and transfer them to him".
Although the plaintiff asserts this claim emphatically, she has not presented any evidence to support it.
