00On November 17, 2009, a meeting was held between the relevant parties, and in fact this is the only time that the parties have met for this claim.
Attorney Rotem testified that at the time he did not know Attorney Meyuhas. According to him, he understood that Kotler was "in addition to the privileged" and that the meeting was meant to "know what he offers us more than others." (p. 184, lines 25-26, p. 190, line 27, p. 191, line 7).
According to Fischer and Attorney Rotem's version, during that meeting, Kotler noted that he had extensive experience and connections with officials in the Tel Aviv municipality. The promise on his part was for significant personal treatment by him and if necessary, a legal proceeding would be conducted by Adv. Meyuhas. Fischer testified: "What I remember is that he said it out loud that he had an idea and something that he could bring down the municipality from all the demands of their 91% and only he knows and he, I understood from the moment we finished signing the agreements that he was already going to deal with it and as he promised." (p. 201, lines 11-14; see also paragraphs 4, 5 of Fischer's affidavit, p. 208, line 18, p. 212, lines 16-17, p. 213, lines 21-32, p. 214, lines 1-6, p. 221, lines 5-6, paragraphs 4, 5 of Adv. Rotem's affidavit).
Due to the representation, which Kotler presented in a criminal and written appeal regarding treatment that he himself would perform, Adv. Rotem recommended that Fischer enter into an agreement with the plaintiff (paragraph 7 of the affidavit). Attorney Rotem testified, "In the end, he chose Meyuhas, because Kotler presented himself that in addition to the legal issue that needs Adv. Meyuhas, he has connections and he already has experience with these things and he is close to the municipality, I don't know how he has connections and he can also help from the side not legally, financially and all kinds of contacts with the municipality, after all, in these things you have to go to the municipality and try to close with them. ... It's by the way that you will know this is the reason, I didn't know Meyuhas before...And I said to him, look, we have someone here who also says I always recommend that I am in favor of the fact that from a legal point of view it doesn't always go the way you want, sometimes when I heard that it is privileged that Kotler also has the connections, I told him that it gives us another niche that we can finish with and therefore I recommended that he go with them" (p. 184, lines 19-30). "When we sat in a meeting with him at Meyuhas's, he was there too, and then he explained that he could bring in appraisers and that he had connections in the municipality and that he would work behind the scenes on all matters." (p. 185, lines 11-13, p. 187, lines 5-7, p. 190, lines 26-30). I found that Adv. Rotem's testimony was credible.
