In order for Kotler to be able to work with the municipality personally, he was given a letter of authorization signed by Fischer (paragraph 5 of the affidavit of Adv. Rotem). "But from the outset we hoped that Kotler would also help us with this in some other way, ... Why did they give him the special power of attorney for what?... If it's not like that, why did he go like that, a power of attorney to the municipality?" (p. 189, lines 29-31, p. 192, lines 12-13).
According to Fischer, it was the added value offered by Kotler that persuaded him to enter into an agreement with the plaintiff, over another entity, such as the law firm Shraga Biran, which represented many tenants and offered its services, in cooperation with Alfia CPA, at a salary similar to the fees charged by Adv. Meyuhas. (Paragraph 5 of Fisher's affidavit, paragraphs 8, 9 of Adv. Rotem's affidavit). The testimony of CPA Alfieh shows that his fees for organizing a group of 161 members, with ongoing handling and coordination between the lawyers and the members of the group for several years, amounted to 1.8% of the savings, while the fees of the attorneys of that group were 6.8% of the savings (p. 13, lines 29-32).
According to Fischer, since Kotler worked together with Adv. Meyuhas, it was decided to hire his services, as the representative attorney, "After all, even in the written agreement it is written that including Adv. ... The thought was, "If Kotler's idea works, you don't need a lawyer." (p. 212, lines 21-26, p. 213, lines 7-10, 23-29). Attorney Rotem testified that it was clear that there would be two treatment tracks: "...He sent me both the power of attorney of Meyuhas and his power of attorney that we will sign both of them for him and return them to him... In other words, there are two paths" (p. 195, lines 12-13, 15, 17-19, 30-31).
According to Adv. Rotem, he was unaware of the existence of a group that had begun to take shape: "As far as I'm concerned, I didn't know there were groups, as far as I'm concerned, I was one person representing my client... There was a separate meeting without any group." (p. 196, lines 7-8, 16-30, p. 197, lines 1-4).
