In other words, with regard to business contracts, and I will already note that in my approach, the contract before us is a contract that can be defined as a business contract - the language of the contract should be given great importance.
- The last shift (for the time being( of the pendulum of contract interpretation took place recently, when on January 7, 2026, an additional amendment was enacted that updated the language of Section 25 - The Contracts Law (General Part( (Amendment No. 3), 5786-2026. I will note that this amendment also does not apply to the contract that is the subject of the discussion, since, in accordance with the provision of section 2 of this law, it will apply only to contracts that were entered into after the amendment of January 7, 2026 (it was further determined in this section 2 that: "In this regard, the renewal of a contract shall be deemed to have been concluded"). At the same time, the clause in its wording reflects the legislature's current approach. In accordance with this amendment, the wording of section 25(a( of the Contracts Law, from the date of the amendment onwards, is:
"(1( The manner of interpretation of a contract and the evidence that will be admissible to its interpretation will be to the extent agreed by the parties; If the parties do not agree on the manner of interpretation of the contract, the contract shall be interpreted in accordance with the other provisions of this Law;
00(2( A business contract that does not contain provisions regarding the manner of interpretation shall be interpreted in accordance with its language only, unless one of the following is fulfilled:
0 (a( The language of the contract alone derives from an unacceptable result;
(b( From the language of the contract alone, a contradiction arises between the various provisions therein;
(3( A contract that must be interpreted in accordance with its language only, whether in accordance with paragraph (1( or paragraph (2), in which the provisions of paragraph (2( (a( or (b( have been fulfilled, shall be interpreted in accordance with the other provisions of this Law, including paragraph (4(;
