Testimony of Jawdat Abu al-Ghayan (hereinafter: "Jawdat"):
When the Dodge turns right onto Altakoa Street, it hits the deceased while Jaudat is on the sidewalk on the right a few meters further ahead, watching what is happening. This is the only eyewitness to the incident and, at least, the only eyewitness who testified before us (on 9 June 2024). Jaudat is a family member of the deceased, "his grandfather and my father are brothers" (p. 176) who lives opposite the deceased's home (see the location of his home in the Talmud). The witness is also a distant family member of the defendant.
As for the incident, the deceased testified that shortly before the car-ramming, he left his house and went out into the street because he heard children swearing and noticed the deceased who was in front of his door. According to him, the deceased told his mother to go inside. The deceased also went inside and then went back out into the street and began walking "upstairs in the direction of his grandfather... "
This is how the witness described the ramming: "And when he (the deceased) came in front of the bumper, the Dodge came out, when the Dodge came out he (i.e., the defendant, D.B.T.) saw it, he caught it and took it to the left towards the sidewalk, when he took it towards the sidewalk, Muhammad wanted to run away and went to the road. And when he went to the road, he followed him... Ahmad. He banged him with a headlight not on the driver's side on the other side, and he has an iron front, they brought him under the car. When they brought him under the car, he got on it with the front wheel and replaced it with the rear wheel and got out... And he went, and he went. He didn't get out of the car, he got out as if he got out of the neighborhood and walked away" (p. 177).
He then saw a vehicle go up to the neighborhood, he put the deceased in the car, went out of the neighborhood with him and called an ambulance that took him to the intensive care unit at Soroka. The witness made two sketches in relation to what he saw (P/28-P/29).
