The threats made by the defendant against the deceased: Tawfiq was asked in his main testimony what the defendant had said to the deceased while the deceased had broken the avansis windshield and answered: "I don't remember and I don't know." After the prosecutor confronted him with what he had said to the police as part of a confrontation with the defendant (during which he slammed the defendant who said to the deceased: "If you're a man, stay there, I'll bring the Dodge, I'll destroy your car on you..." Tawfiq replied: "I don't remember and I don't know. Why did I say that, I said it when I was angry about him." Alongside this answer, he reiterated that he did not confirm that he said these things. After the court remarked to the witness that, as such, there is no dispute that he said the things since he is recorded saying them, he replied, "I do not remember and I do not know" (p. 262) (the emphases are not in the original, and so is D.B.T.).
Following the aforesaid, the prosecutor asked to declare the witness a "hostile witness" and the court granted the request. Later in his testimony in which he was interrogated by way of cross-examination, Tawfiq claimed that everything he testified was true, but that he did not remember the threats described by the defendant towards the deceased, and similarly repeated that if he said so, it was because he was nervous. The witness claimed that he did not change his version because he was afraid, and that the words were said because he was angry about the defendant at the time: "And if there was a possibility of attacking him, I would have attacked him in the testimony of me and him as well. What is it, it was a hot story, this is my cousin, what do you expect me to do" (p. 265).
Tawfiq explained that the deceased asked him to tell the defendant to stop pressing the gas because the defendant was "a very good friend of mine, he respects me and I respect him" (p. 269). He offered the defendant to pay for the windshield "because it's in my place, I know him, I told him (I didn't hear him) and another one told him I'll pay you" (ibid.). According to him, at some point he suddenly heard children telling him to bring the car to take the deceased to the hospital because Ahmad ran him over, he started the car right at the gate of the washing institute and then he saw Adam reverse and that the deceased was being taken to the hospital.
