On the basis of the testimonies that I reviewed above, I determine that Yuli collected Naveh's devices from the Spy Shop, via a courier, hacked them using a computer and software, and extracted information from them that was related to Naveh. He edited the information in folders, "downloaded" it to a portable device (disk-on-key) that he gave to Steif. Shteif was aware of this process, and even confirmed it during the meeting at Yuli's home. Shteif then printed out the information and filed it in two binders (black and white) and in a "plastic bag", in preparation for the meeting with the other defendants and the legal support parties.
The meetings on Army Radio and Barkai's home
- Shteif brought all the printed materials with her to a meeting held on December 24,2018 in Elkabetz's office. Present at this meeting were: Elkabetz, Barkai, Steif, Canetti and Adv. Ravit Danino (hereinafter - Adv. Danino), Head of the Counseling and Legislation Branch of the Military Advocate General's Corps, which replaced Adv. Maya Blumenfeld (hereinafter - Adv. Blumenfeld), the legal advisor of the radio station Galei Tzahal, who was abroad at the time. Elkabetz, Barkai and Kanti confirmed in their testimonies before me that they knew that the materials were produced from devices given to Steif by Hani (Elkabetz's testimony: par. p. 396, paras. 23-28; Barkai's testimony: par. p. 258, par. 19; Canetti testimony: par. p. 445, par. 19)
- Elkabetz explained that the legal advice at a meeting of this kind, which was held in his office, is extremely important. According to him: "... I asked that this whole story be with legal advice... It was very big in terms of exposure and of the affair, and I just wanted to act responsibly and with the necessary caution. Because on the one hand there are very large arguments that I want to know how they are substantiated, on what basis things are said, how they are said" (Par. p. 398, paras. 4-8). And also: "As soon as you are brought material that is unreasonable in the level of information you receive... I am obligated, I have a responsibility as editor-in-chief, as the commander of the station... to ensure that all the material undergoes legal advice and that I am 100 percent based on the publication" (para. p. 405, paras. 20-26). Barkai also explained that the presence of legal counsel is required when there is a concern that the publication will amount to defamation, invasion of privacy, or violation of security (para. p. 275, paras. 2-4). In the case at hand, he explained "What I know is that these are sensitive disclosures are accompanied by legal advice that can come for reasons I stated a few minutes ago. You are trying to say that I knew that this was a concern of theft or invasion of privacy, I did not know, I did not get into it at all" (para. p. 275, paras. 30-32).
- Adv. Danino explained that on the same day she came to the radio station "on another matter to conduct a lottery regarding a news broadcast broadcast on Galatz... In an unusual way, I came to the station myself, I had no direct contact with the station on an ongoing basis. When I arrived, then Shimon, the commander of the Galatz station, came out of his office where a meeting was held, he left the meeting for the purpose of the lottery and he said that at the end of the lottery I would enter his office because they wanted to update me" (Par. p. 376, paras. 21-25)
- Elkabetz, Barkai Canetti and Adv. Danino explained that at this meeting they were exposed to the information that Steif presented to them about Naveh, but only verbally. According to Elkabetz: "Hadas presented the remarks, the very dramatic and very, very unprecedented information in terms of what was said in the room" (par. p. 398, paras. 1-3). And also: "Hadas arrived in an orderly manner with materials, some of which were in binders" (par. p. 398, s. 29). However, "I don't think I looked at the materials that were related to the binders" (Par. p. 256, s. 27).
Barkai's testimony showed that At the meeting, "Hadas presented her revelations to us in a verbal manner in the headlines, mainly headlines. I think I understood it already, Hadas said already in the meeting that the meeting was after she had already informed the commander of Army Radio, who is also our editor-in-chief. I was shocked, just shocked, I want to say that I didn't know Effi Naveh, I must have interviewed him several times, either as chairman of the Ethics Committee of the Bar Association or as the chairman of the Bar Association, I got the impression that he was a smart and talented man and I always thought that his role was a role like judicial, in my eyes the chairman of the Bar Association is a role like judicial. Suddenly I became acquainted with the jury in which he was. The materials were visceral" (par. p. 256, paras. 19-25). According to him, This meeting did not examine physical material because "it was a meeting of chapters, it was clear that it would have a continuation" (par. p. 256, para. 27). And also: This meeting was "a meeting of headlines without being exposed to the material" (par. p. 277, s. 31). Adv. Danino also explained that "Hadas did not show me materials from the binders. The entire conversation in Shimon's room was oral" (par. p. 377, para. 5).
- Canetti explained that on the day of the meeting she was supposed to be on vacation, but canceled it after Shteif told her that "she had a big story and that I had to come to the meeting" (par. p. 442, paras. 1-4). According to her, when she arrived, "I think most of the people were seated. There were Hadas, Shimon, Razi, maybe that legal advisor Ravit as well... Hadas opened by saying that she had a big story, gave a brief on a few ... topics and that's it" (par. p. 442, paras. 7-8,10-11). The material to which Kanti was exposed at the meeting, described as follows: "She (Shteif - A.S.) She spoke about the HaBayit HaYehudi affair. Something, a suspicion that the chairman of the Bar Association at that time helped the Minister of Justice at that time to visit lawyers from different ministries or from one office to HaBayit HaYehudi, which was her party. There was the case of Judge Krief. There was a suspicion in Hadas's opinion of what was later called sex in exchange for an appointment, and there was another judge, a lawyer who was apparently in intimate relations with Effi Naveh and in order to arrange a judgment for her husband or something like that" (par. p. 442, paras. 13-18).
- In her testimony, Shteif explained unequivocally that at this meeting she presented the binders to those present, while noting that the materials came from phones that Hani had transgressed. According to her: "I put the binders on the table, passing them to Razi, Nurit, Ilil, it was not digital, while pointing out material things and I tell Ravit what was in the materials, at this point I mention that these are phones that Hani committed offense that are not in my hands" (par. p. 165, paras. 35-36, p. 166, s. 1). According to her, "The legal advisor sitting in the room is supposed to protect me and Razi and everyone, she doesn't say even once to close the binders, put materials aside in the safe, don't touch them, everything she says she should consult with her bosses in the army" (par. p. 165, paras. 25-36). And also: "The only thing we were told was that we can't publish anything until we get a green light from them. That's what we always do anyway" (par. 166, paras. 24-25).
- In her testimony to the police, Shteif also explained that she, Barkai and Kanti reviewed the materials as follows: "The discussion was about whether we could publish any of these materials and how... After the legal hearing, Elkabetz and the legal advisor left the room, and Razi Barkai and I, together with Canetti, remained to review the materials in binders in order to understand their severity and significance" (P/22).
- At the end of the meeting, the Adv. Danino informed those present that until another decision is made, the materials produced from Naveh's phones should not be published. This is what emerged from her testimony: "They asked to publish the investigation and I told them to stop, there are issues here from the world of privacy protection and defamation, I need to do my homework and update my superiors" (par. p. 377, paras. 5-7).
