Main Inquiry

  1. In this section, Marciano's testimony will be presented insofar as it relates to the fourth charge.

An investigation was launched regarding a problematic check by the contractor Arik Shaked – the same check for NIS 24,000 in which the word "Alef" was not registered. The police wanted to know under which card the check was cashed, and it turned out that the card at the exchange was opened in the name of Zeidpods and that there were five other checks cashed on the same card, while Zeidpods were not in Israel at all (p. 389). The police understood that the defendant was the one who cashed the checks. Locations of the defendant showed that on almost all the dates on which the checks were cashed, the defendant was located near the change (p. 389). Benny Bezov confirmed that the person who cashed these checks was the defendant. There were also conversations on the dates on which checks were cashed, in which the defendant asked his accused wife to fax him a photocopy of Zeidpodim's ID card (p. 389).

  1. Marciano testified about an inspection in the field carried out by Sgt. Oppenheim, head of the Construction Branch of the IPS during the relevant period, the purpose of which was to check whether the bills of quantities contained greater numerical values than what was actually carried out in the field.

Oppenheim inspected the project of sealing the absorption complex in Abu Kabir. He went up to the roof with the bill of quantities, checked the scope of the roof, its area and the number of gutters, calculated and found gaps of hundreds of percent between what was recorded in the bills of quantities and what actually existed. For the avoidance of doubt, since this is a very small roof next to an additional roof of the visitor center, the witness asked Oppenheim to inspect the additional roof as well.

Even when the two roofs are connected together, there are still large gaps. When this was hurled at Arik, he admitted that inflation had been carried out and explained that the method was to inflate the project by tens of percent, and to receive an inflated payment from which the defendant's percentages were deducted (pp. 392-393). The witness noted that Arik, as well as Roni Coffey (hereinafter indictment 13), who do not know each other, told the same story: how they met with the defendant in his office, the defendant took a note, wrote down the total amount above, and below he wrote down a sum of 10%, circled around and said: "This is for me" (p. 393).
