  1. The defendant denied the aforesaid charge according to which he paid or sought to pay the cutter for work in the motel through Tavorinsky.

Charge 8 - Evidence

The Prosecution Case

Testimony of Hatuka (transcript of July 12, 2021)

Main Inquiry

  1. Hatuka testified that the defendant invited him to the top floor of the motel and asked him to build a pergola (awning) there. He built the canopy (which has the option of closing it and using it as a room), and demanded NIS 35,000 for the work, including VAT (pp. 38-39).
  2. Exhibited for the cut is Exhibit P/23 - Invoice No. 1416 dated February 8, 2017 for the construction of a pergola in Neve Tirza, which he spent for D.B.S., in the sum of NIS 35,000. To the question of what was Tavorinsky's connection to the work for the defendant, he replied that he did not know, that he did not know Tavorinsky and was not in contact with him (p. 39). To the question of why it was written in the invoice that the work was a pergola in Neve Tirza, he replied that when he finished the work, the defendant asked him to come to the office (to the best of his recollection) and issue an invoice with the details stated – for D.B.S. Tavorinsky, for the construction of a pergola in Neve Tirza in the sum of NIS 35,000. Hatuka told the defendant that they had already issued an invoice for a pergola (apparently referring to the work that is the subject of indictment 5 – M.B.), and the defendant reassured him not to worry about the matter (p. 40).
  3. In 2017, he did not perform any work for the IPS at all. Since the construction of the roof in Neve Tirza, he has not performed any work for the IPS (p. 40).

P/24 - Receipt No. 1398 for a check that he received from Taborinsky, against invoice No. 1416, dated February 8, 2017, when he received the payment (p. 40).

P/22 - Correspondence with the defendant, dated February 1, 2017. On the second page of the exhibit appears Cutta's question as to whether there is anything new regarding the check (p. 41). The check came to him through the defendant (p. 41).
