Cross-examination
- To the question of whether he knew that this was a loan that Tavorinsky gave to the defendant due to his difficult financial situation at the time, Hatuka answered in the negative (p. 61). He was asked about the fact that he said in his interrogation that he had issued an invoice to the contractor "that he says that he took a loan from him" (interrogation dated December 10, 2018), and replied that the interrogator noted that the defendant said that he had received a loan from Tavorinsky (p. 62). Hatuka denied the claim that Tavorinsky was the one who gave him the check and told him in a phone call what to write on the invoice, and insisted that he had not spoken with Tavorinsky (pp. 62-63). He did not know Tavorinsky, and the defendant asked him to issue an invoice and write on it the construction of a pergola in the IPS (p. 64).
- The offer he made to the defendant for the work that is the subject of indictment 8 was not in writing, but orally. Only the discussion on the issue of adding isolation was done on WhatsApp. When he said in the interrogation on December 10, 2018, that he had submitted an offer to the defendant, he was referring to the oral proposal (p. 63).
- The witness does not know what Tavorinsky did with the invoice (pp. 63-64). He cannot rule out that Tavorinsky gave a loan to the defendant, because he does not know Tavorinsky (p. 64).
- In the interrogation on December 10, 2018, he said that he met with the defendant in his office, and the defendant came to pick him up from the gate and brought him Taburinsky's check. To the argument that every entry to IPS facilities is registered, whereas there is no record of Hatuka's entry on that day, the witness replied that when he entered Neve Tirza his entry would have been registered, but in this case it was not a detention facility (pp. 67-68).
