Charge 9 - Evidence
The Prosecution Case
Testimony of Hatuka (transcript of July 12, 2021)
Main Inquiry
- During his testimony, Hatuka was presented with various exhibits – correspondence between him and the defendant that was spread over several months, conversations between him and the defendant, as well as photocopies of Hatuka's invoices and the check he received from Klaus – all of which will be detailed below.
- Hatuka testified that in 2018 the defendant asked him to make a roof for him over the entrance door of the motel (p. 41). According to the correspondence, Hatuka testified that the work that is the subject of the indictment was completed on May 3, 2018, when he sent the defendant a picture of the awning and announced the completion of the work (p. 41). The payment was delayed because the defendant wanted to find out how to issue an invoice, and later he asked Khota to issue a different appeal invoice, D.B.S. and to indicate on the invoice "entrance in an existing building" (p. 42). At a certain point, the defendant asked him to issue a new invoice for the same amount, a different appeal Klaus (p. 43). Klaus testified that he did not know Klaus. He received the check in August or October (p. 44). After he was played a phone call between him and the defendant on September 20, 2018, he said that he had arrived at the defendant's home that day to receive Klaus's check, and that the defendant called someone who had come down to him from the house and brought him the check (p. 44). He feared that if he did not do as the defendant said, he would not be paid for his work (p. 45).
- Exhibits submitted during the main investigation:
P/22 - Correspondence between the defendant and Hatuka. On June 6, 2018, Hatuka wrote to the defendant: "What's going on?? I hope you haven't forgotten me." The defendant replied that day that he had not forgotten and that he would try "by the end of the month to settle an account." On July 19, 2018, the defendant wrote: "An invoice to D.B.S. Tavorinsky Ltd.". Hatuka asked what to write on the invoice, and the defendant replied, "Roofing of an entrance in an existing building". Hatuka asked if a location should be specified, and the defendant answered in the negative. On July 23, 2018, Hatuka submitted a file for his handling (apparently the invoice). On July 30, 2018, Hatuka asked if there was anything new regarding the check, and the same was true on August 20, 2018.
