Prosecution Witness No. 3 - Mr. Guy Cohen
As part of his testimony in the main interrogation, his testimony was submitted to the police - Submitted and marked P/5.
In his testimony to the police of 246.23 (P/5), the witness said:
"I'm driving back home from Kibbutz Negba, the road was wet, I remember it wasn't raining, maybe it was a slight drizzle, but it wasn't raining, I was about 300 meters away from the accident when a car driving towards Lachish Junction passed me and it flashed at me, I slowed down and within 10 seconds I realized the situation, I stood at first in the middle of the road with flashing lights maybe I drove a little back so they could see me. I immediately reported it to the police while my wife was talking to MDA at the same time, and then an MDA volunteer arrived and I took a flashlight and stopped the traffic in both directions and only while I was running and stopping traffic did it start to rain and then when I saw that the traffic was stopping I went back to the car and went down to the grove and lit up the scene.
Q. Did you notice one of the vehicles involved before the accident?
A. Nope.
Q. Do you know which of the vehicles came from which direction?
A. The black car came from my direction and the small white car came from Eliav.
Q. How did you understand that?
A. Only in retrospect after the accident.
Q. Have you spoken to anyone involved?
A. Only with the driver of the black car, he was walking around the scene sleepwalking, and I told him to sit down until they came to evacuate him.
Q. Did you see the accident itself? Do you know who swerved from his lane?
A. No, and no.

Q. Was the road wet or dry?
A. The road was wet, it might have rained 20 minutes before that.
Q. Do you want to add something?
A. There were a lot of plastic pieces in the middle of the road that I turned before the fire and MDA arrived."
In his cross-examination, he testified, because he remembers that a car drove in front of him and flashed at him. To the question of why the vehicle flashed, he testified:
"This road is constantly full of cows and tractors and it seems to be flashing to warn me." (See his testimony of 8 January 2025, p. 17, para. 15).
