When asked what he meant by his words to the police, "I slowed down and within 10 seconds I realized the situation, " he testified:
"A. I noticed a vehicle standing facing against the direction of traffic and another vehicle that was on the curb of the ditch facing towards the road
Q. How long has it been since the car passed by you and flashed you until you saw the situation?
A. seconds, something like 10 seconds.
Q. Are you the first in the ring?
A. No, I'm not the first in the scene, there was another jeep on the curb that lit up in the direction of the car facing me on the left, let's just say I was the second car in the scene.
Q. Has anyone passed you?
A. From the moment I arrived at the scene, I stopped in the middle of the road and no one passed me.
Q. You came from the direction of Lachish from the direction of the defendant's car, did you see this vehicle, the defendant's vehicle in front of me?
A. Anonymous
Q. What was the weather like?
A. A very wet road with a slight drizzle." (See his testimony of 8 January 2025, p. 17, paras. 18-31).
The witness was asked what he had done from the moment he arrived at the scene of the accident and he testified:
"A. First of all, I put my car in the middle of the road with 4 winks, take my phone and flashlight, run down the road while I report the incident to the police, pass plastics and things scattered on the road and stop a truck coming towards me and ask it to stand in the middle of the road and go to help at the scene.
Q. I don't know how many accidents you have witnessed, do you understand that in the place where the accident occurred, the fragments and plastics that are present in the place are significant?
A. Yes
Q. Explain to me that if you understand this and no one crossed the road, even before the forces, the fire department, MDA and the examiner arrived, why are you evacuating parts of the accident from the road, as you said in line 29 of your testimony? And where did you evacuate them?
A. I have a son who volunteers with MDA and was with his girlfriend who is also a volunteer at MDA at home and I allowed them to come into the arena to treat, I took off the barriers of one bumper. All the small pieces remained in the area.
Q. When you say and I quote "that there were a lot of plastic parts in the middle of the road that I turned before the fire brigade and MDA arrived...", does that mean that Finnish was just a bumper?
A. Maybe in an event like this, I realized that there were trapped people and we had to get to them, so I don't know if I just took out the bumper, but I remember that there were small parts scattered and still remained on the road.
To Beyham's question"Q, I'm explaining to you the defense attorney's question before the court, you testified that you moved one bumper and in your testimony to the police you said you moved a lot of plastic parts, so what's true?
The witness replies: It could be that the word "I moved" was confused with the word "I saw." (See his testimony of January 8,2025, p. 18, paras. 2-21).
